The Indian Child Welfare Act has come under fire-again. ICWA was passed by Congress 40 years ago and is considered the gold standard of child welfare policy. Its goal was to stop the separation of Indian children from their families and thereby promote family stability and integrity. In a recent ruling in an ICWA case (Texas V. Zinke) by United States District Court for Northern Texas, the court said that ICWA was unconstitutional. Basically, the court said that ICWA was race-based. This ruling turns the fact that Tribes are political governments on its head. In the aftermath of that drastic decision, the Brookings Institute published an article written by Randall Ackee.
